Horse Riding Lesson Liability Waiver & Release

This waiver is applicable to ALL visitors to Circle T Ranch Arizona whether you are a participant in an activity or an observer.
1. Acknowledgment of Risk
I understand that horseback riding and related activities are inherently dangerous and involve risks that may result in serious injury or death. Horses are living animals and even a horse trained to its highest level can act unpredictably. These risks include, but are not limited to:
Falling from a horse
Being kicked, bitten, or stepped on
Equipment failure
Unpredictable behavior of horses
Terrain hazards and environmental conditions
I understand that in addition to the inherent risks associated with horseback riding, participation in activities at Circle T Ranch Arizona LLC with Community Horse Power LLC involves exposure to a working ranch environment. This includes, but is not limited to:
The presence of livestock and other animals including but not limited to horses, cattle, goats, chickens, dogs, and cats.
The presence of wildlife
Ranch equipment, machinery, vehicles, and tools
Uneven terrain
Fencing, gates, posts, poles, and other ranch structures
Feed, hay, dust and other environmental elements that can trigger allergies.
I voluntarily choose to participate in horseback riding lessons and related activities at Circle T Ranch Arizona LLC with Community Horse Power LLC.
2. Release of Liability
In consideration for being allowed to participate, I hereby release, waive, and discharge Circle T Ranch Arizona LLC and Community Horse Power LLC, its owners, employees, instructors, volunteers, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any injury, damage, or loss that may occur as a result of my participation.
3. Arizona Equine Liability Law Notice
Under Arizona law, an equine owner or agent is not liable for injury or death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to Arizona Revised Statutes § 12-553.
4. Assumption of Risk
I knowingly and voluntarily assume full responsibility for all risks associated with participation in horseback riding activities or being on the property at Circle T Ranch LLC with Community Horse Power LLC.
5. Safety & Conduct Agreement
I agree to:
Follow all instructions given by instructors and staff
Wear appropriate footwear (closed-toe shoes/boots)
Wear a helmet
Not engage in reckless or unsafe behavior
Non participating parties must stay within lesson area and may not wander around property.
Any minors not participating in actives must be with a supervising adult at all times.
Circle T Ranch Arizona LLC and Community Horse Power LLC reserves the right to refuse participation to anyone who does not adhere to safety and conduct agreement or other rules posted at the ranch.
6. Medical Disclosure
Horseback riding and other ranch or farm style activities require certain safety standards. In accordance with ADA law, Circle T Ranch Arizona LLC and Community Horse Power LLC does not discriminate against those with medical conditions or disabilities. Reasonable accommodations can be made as long as it does not alter the nature of the activity or pose a safety risk to participant or animal. Please disclose any medical conditions that may affect the participants ability to safely ride, be around, or interact with horses or other animals on property so that safety can be evaluated and reasonable accommodations can be made. Examples include but are not limited to:
Conditions that affect balance, vision, reflexes
Conditions that affect ability to understand or follow verbal commands
Conditions that affect physical ability to safely mount/dismount a horse
Conditions that may result in sudden loss of ability to control a horse (seizures, narcolepsy, syncope etc)
A doctors note clearing participant to take part in certain activities may be required at the discretion of Circle T Ranch Arizona LLC and Community Horse Power LLC.
7. Medical Consent
In the event of an emergency, I authorize Circle T Ranch Arizona LLC and Community Horse Power LLC to obtain medical treatment for me. I understand I am responsible for any medical expenses incurred.
8. Indemnification
I agree to indemnify and hold harmless Circle T Ranch LLC and Community Horse Power LLC from any claims brought by or on behalf of me or a minor participant.
9. Governing Law
This agreement shall be governed by the laws of the State of Arizona.
